Description of Service

Nstride provides a platform for discovering running routes and races, predicting performance based on uploaded GPX files, and managing personal route collections. The application offers predictive algorithms, route databases, and mapping features to assist runners in planning and evaluating their training and race strategies.

User Accounts

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users must notify Nstride immediately of any unauthorized use of their account. Users must provide accurate and complete information when creating an account and keep this information updated.

User Content and Data

Users retain ownership of the GPX files and route information they upload to Nstride. By uploading content, users grant Nstride a license to use, process, and display this content solely for the purpose of providing the application's services. Users are responsible for ensuring they have the right to upload any content they submit.

Users agree not to upload content that:

• Infringes on intellectual property rights of others
• Contains malicious code or viruses
• Violates any applicable laws or regulations
• Contains false or misleading information

Prediction Accuracy

Performance predictions provided by Nstride are estimates based on algorithmic analysis of uploaded GPX data and route characteristics. These predictions are for informational purposes only and should not be considered guarantees of actual performance. Actual race or route performance may vary significantly based on numerous factors including weather, training, health, and course conditions.

Acceptable Use

Users agree to use Nstride only for lawful purposes and in accordance with these terms. Prohibited activities include:

• Attempting to gain unauthorized access to any part of the application
• Interfering with or disrupting the application's functionality
• Using automated systems to scrape or download content
• Impersonating other users or entities
• Using the application for any commercial purpose without authorization

Intellectual Property

The Nstride application, including its design, code, algorithms, and branding, is protected by intellectual property rights. Users may not copy, modify, distribute, or create derivative works based on the application without explicit permission.

Disclaimer of Warranties

Nstride is provided "as is" and "as available" without warranties of any kind, either express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Nstride does not guarantee that the application will be uninterrupted, error-free, or free from viruses or other harmful components.

Limitation of Liability

Nstride shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from use or inability to use the application. This includes damages for loss of profits, data, or other intangible losses, even if Nstride has been advised of the possibility of such damages. Users assume all risks associated with their use of performance predictions and route information.

Safety and Health Disclaimer

Running and physical activity carry inherent risks. Users should consult with medical professionals before beginning any exercise program. Nstride does not provide medical advice and is not responsible for injuries or health issues that may result from following routes or predictions provided by the application.

Modifications to Service

Nstride reserves the right to modify, suspend, or discontinue any aspect of the application at any time without notice. Nstride is not liable to users or third parties for any modification, suspension, or discontinuation of the service.

Termination

Nstride may terminate or suspend user accounts and access to the application at any time, with or without cause, and with or without notice. Users may also terminate their account at any time through the account settings. Upon termination, users' rights to use the application cease immediately.

Changes to Terms

These Terms of Service may be updated periodically. Users will be notified of significant changes through the application or via email. Continued use of Nstride after changes constitutes acceptance of the updated terms.

Governing Law
